Professional Indemnity - Frequently Asked Questions

Who is a Professional?
A professional can be any person, partnership or company providing advice, design, specifications or other professional services.

What is Professional Negligence?
Professional Negligence can be defined as "the failure to meet the standards of care to be expected from the average competent and experienced practitioner as to render the professional person committing the act, error or omission liable at law to a client or some other third party".

What Professional Indemnity Extensions of Cover are available?
Professional indemnity policies can be extended to also include loss of documents, fidelity, libel & slander, acquisitions, court attendance costs, mitigation of loss, intellectual property, reinstatement of limit of liability and collateral warranties.

Professional Indemnity Claims Conditions
Professional indemnity policies are written on a "claims made" basis which means that the policy covers claims made during the period of cover. This is different to most liability policies which provide cover for incidents that occur during the policy period.

Retroactive Date
Retroactive dates provide cover for work you have done prior to the commencement of the professional indemnity cover. The further back the retroactive date the better your cover. Furthermore, if a policy does not have a retroactive limit, it will provide cover for previous work without limitation.

Excesses
An excess is the amount you are responsible for in the event of a claim made against you. Typical excesses for professional indemnity policies are £500 rising to £5,000 for higher risk professions. Refer to your own policy for your specific excess.

Run Off Cover
When you retire you could still find yourself liable for work you carried out prior to retirement. In order to ensure that you don't find yourself uninsured for a claim made after you have retired, most professionals purchase a 'run off' professional indemnity policy which will typically cover you for up to 6 years after your retirement.Professional Indemnity Insurance Quote Form
