Why Do I Need Builders Public Liability Insurance?

Public liability insurance provides cover in the event of claims made against you by members of the public for injury, illness, death or disease caused by you in the line of your work. An example of this could be if you are building an extension and materials or tools dropped from an upper floor or roof causing injury to a passer-by. Personal injury claims can run into many thousands of pounds and your public liability insurance is designed to cover builders / building contractors for such an event.

Cover is also provided for third party property damage (e.g. a ladder falling on a nearby vehicle) and legal defence costs.

Builders Employers Liability Insurance

Employers liability insurance is required by law if you employ your own workers. You are required to cover both your own direct employees and any labour only sub-contractors that you use under your builders liability insurance policy. Labour only sub-contractors are those sub-contractors that provide labour only and work under your your direct supervision with materials that you supply.

Bona fide sub-contractors (also known as supply and fix sub-contractors) are those that work supply both their own labour and materials on site and have their own insurance and are typically skilled trades such as electricians, plumbers, roofers, etc. Bona fide sub-contractors do not need to be included as employees as they should have their own insurance, however, your annual payments to them do need to be disclosed to your insurers in the event that a claim is made against you, where you are the principal builder in a project.
